These Terms of Use (“Terms”) govern your access to and use of newh.org and any related websites, member portals, or online services operated by NEWH, Inc. (“NEWH,” “we,” “us”). By using our website, you agree to these Terms. If you do not agree, please do not use the site.
These Terms apply to everyone who visits our website, whether you are a member, a guest, a scholarship applicant, or simply browsing. Members are also subject to the NEWH Member Agreement, which governs the membership relationship in addition to these Terms.
NEWH, Inc. is a 501(c)(3) nonprofit organization incorporated in Wisconsin, USA. We support professional education, networking, and scholarships across the global hospitality design community.

The last point matters to us. NEWH is not a mailing list — it’s a community. Using member information for cold outreach or commercial solicitation violates these Terms and may result in suspension or termination of your access and your membership.
Some areas of NEWH’s digital presence allow you to post content — for example, member directory bios, photos shared from events, and forum or discussion posts within our member portal.
You keep ownership.You retain ownership of any content you post.
You give NEWH a license to use it.By posting content, you grant NEWH a non-exclusive, royalty-free, worldwide license to display, distribute, reproduce, and adapt your content for the purposes of operating NEWH, promoting NEWH’s mission and events, and supporting the NEWH community. This license continues for content you have posted even if you later leave NEWH, but you can ask us to remove your content at any time.
You’re responsible for what you post.You are responsible for ensuring you have the rights to any content you share, that it is accurate, and that it does not violate anyone’s privacy, intellectual property, or other rights.
We can remove content.We may remove or edit any content that violates these Terms, our Member Agreement, our Code of Conduct, or applicable law, or that we determine is inconsistent with the values and purpose of NEWH. Where practical, we will let you know if we remove your content.
All content on the NEWH website that is not user-generated — including the NEWH name, logo, chapter logos, taglines, the names of NEWH events, programs, and initiatives (including but not limited to TopID, the College of Fellows, the NEWH Leadership Conference, and our scholarship programs), and the text, images, design, and layout of the site — is owned by NEWH or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may view and share NEWH content for personal, non-commercial purposes, and members may use NEWH materials as needed to participate in NEWH activities. Any other use — including reproducing, distributing, modifying, or using NEWH branding for commercial purposes or in a way that suggests endorsement or affiliation — requires our written permission.
Our website links to third-party sites — including chapter pages, sponsor sites, vendor platforms, and educational resources. We provide these links for convenience and to support our community, but we do not control or endorse the content, products, services, or privacy practices of third-party sites. Your use of any third-party site is at your own risk and subject to that site’s own terms.
This includes our member portal, which is operated by a third-party vendor. The portal is governed by these Terms and our Member Agreement to the extent NEWH controls the experience, but the underlying platform is provided by our vendor and may be subject to additional terms.
Your use of the website is also governed by our Privacy Notice, which explains how we collect, use, and share personal information. By using the site, you acknowledge that you have read the Privacy Notice.
The NEWH website and all content, services, and materials available through it are provided “as is” and “as available,” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, NEWH disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We work hard to keep the site running and our information accurate, but we do not guarantee that the site will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not guarantee that information on the site is complete, current, or accurate at all times.
Educational content, scholarship information, and industry resources on the site are provided for general informational purposes and do not constitute professional, legal, financial, or career advice.
To the fullest extent permitted by law, NEWH, its directors, officers, employees, volunteers, chapter leaders, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the website, including loss of data, loss of profits, or loss of goodwill, even if we have been advised of the possibility of such damages.
For any direct damages, our total liability to you for any claim arising out of or relating to these Terms or your use of the site is limited to the amount you have paid NEWH in the twelve (12) months immediately before the event giving rise to the claim. For users who have not paid NEWH anything, our liability is limited to one hundred US dollars (USD $100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
You agree to indemnify and hold harmless NEWH, its directors, officers, employees, volunteers, chapter leaders, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your violation of these Terms, your misuse of the site, or your violation of any law or the rights of another person.
We may suspend or terminate your access to the site at any time, with or without notice, if we believe you have violated these Terms, our Member Agreement, our Code of Conduct, or applicable law, or if we determine your conduct is inconsistent with the values and purpose of NEWH.
If you are a member, suspension or termination of site access may also affect your membership. Membership-related consequences are addressed in the Member Agreement.
You may stop using the site at any time. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will continue to apply.
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent change. If we make material changes, we will let members know through our usual NEWH communications channels. Your continued use of the site after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Wisconsin, USA, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or your use of the site will be brought exclusively in the state or federal courts located in Wisconsin, and you consent to the personal jurisdiction of those courts.
If you are located in a jurisdiction whose laws give you mandatory protections that cannot be waived by agreement, those protections still apply to you.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. Our failure to enforce any provision is not a waiver of our right to enforce it later. These Terms, together with the Privacy Notice, the Member Agreement (if applicable), the Code of Conduct (if applicable), and any other policies referenced here, are the complete agreement between you and NEWH regarding your use of the site.
